Doesn’t it? I am pretty sure they have authority over everyone. US and other non signatories just do not have to hand them over. But if they ever visit a signatory state, they should be arrested.
In theory, they do, but the US not only doesn’t recognise the authority of the ICC, they have provisions for a military invasion of the Hague/Netherlands if a member of the US armed forces is tried in the ICC.
No they only have jurisdiction if the crimes are either committed by a member state or in a member state.
The third way is a Security Council vote but the US has veto.
