If casinos want to be able to use laws like this, they shouldn’t be allowed to kick out people who are too good at the games.
My understanding of people who count cards on Blackjack(The only situation where it is “too good at the games”) is that a Casino put restrictions on their play when caught - they can only play 1 box, and at minimum bet. And that is assuming that a Casino isn’t just using Continuous Shuffling Machines.
This at least used to apply at Skycity Adelaide. Because yeah, it isn’t a crime to have a good memory.
It’ll depend on the casino and the player. A heavily bankrolled team or individual card counter are more likely to get kicked out than someone who’s doing it for fun and winning on the order of a few hundred dollars. This guy has a bunch of videos showing his experiences as a professional card counter and how casinos often like to skirt around the law when dealing with card counters

Personally, I’m of the opinion that if a particular crime entails a certain (high) degree of effort/coordination and you succeed, you should just be let off and get to keep whatever you’d initially gotten away with.

Not wholesome but also interesting: I recall a Russian mafia managed to acquire an Australian slot machine, and reverse engineer it to discover the psuedo-random number generator was effectively a huge but finite list of random numbers, in order, that would just loop back around to the start once it reached the end of the list. So they developed a simple phone app to put in operatives’ pockets, and record the spins (e.g. a cherry-cherry-apple spin might be swiping up-up-left). After a few of these, the app would figure out where in the list the machine was currently at, and the app would vibrate whenever the next one was going to be a winning spin, so they could bet higher amounts on them.
