Locking this post, as people are behaving horribly in the comments.
TLDR: husband caught his wife cheating through the camera of a robot vacuum, then decided to start recording the affair to help his legal case. He won NT$500,000 but since he illegally recorded the affair he was sued back and fined NT$150,000 (or prison time if he wishes not to pay)
NT$500,000 is about $15K in USD.
If he pays, he still comes out 350k on top. I have no idea how Taiwan legal system works, but I assume lawyers aren’t stupid expensive like they are in the usa.
Funny that you can sue for damages if your marital partner is cheating
I suppose that has to do with privacy laws in whatever state/country… And whether or not they have been updated for modern considerations… Or persist to protect an individual’s privacy regardless of modernization… It all depends on one’s perspective.
I say all of this, of course, without knowing the specifics of the case, nor the specifics of the local laws in question.
The man from Taoyuan, Taiwan, was sentenced to five months in prison for unlawfully recording intimate images.
His suspicions eventually led to a discovery on Christmas Eve. The husband accessed a robot vacuum at the property remotely through an app, intending to communicate with his wife using the device.
Instead, its live camera showed that another man was there, and he then activated the recording function, capturing footage of the two together.
It wasn’t for catching her cheating, it was for unlawfully recording her having sex.
On one hand - yeah. On the other - perfect evidence for the divorce case.
I mean, it’s not like he deliberately set up a hidden camera to record her having sex. Just used an already available camera, that presumably she knew was there, since you usually buy that kind of stuff together.
Without this recording she says she didn’t cheat, he cannot prove otherwise, and money and assets get split unfairly.
Not necessarily saying this is how the case should have went. It’s just another angle to look at the situation from.
Can you imagine, every time you try to cheat the god-damned roomba zooms right into the room
No, he literally got in legal trouble not for catching his wife cheating, but for illegally recording her.
He got in trouble for obtaining proof of her cheating, without which he may not have won the settlement that he won.
There are other ways to catch cheating that don’t involve illegally recording someone without their consent.
The fact that people in here are trying to justify crimes against this woman is wild. Cheating doesn’t strip away your rights or give permission for a spouse to abuse the other for cheating.
I’m not disagreeing with you or justifying his actions. Just presenting the other side of the argument.
I’m curious though. How would you propose he catch her cheating, including proof beyond reasonable doubt, that would guarantee a similar settlement or better?
In the end, he got a nice settlement, but had to pay back a little less than a 3rd of it back for the recording. Sounds mostly fair, though I’d make it maybe a 5th or less instead of a 3rd.
How would you propose he catch her cheating, including proof beyond reasonable doubt, that would guarantee a similar settlement or better?
If there is a start recording button there is a stop recording button, he could have tried to avoid filming during sex perhaps. Maybe there are other camera’s in the house, or a video doorbell… but generally I agree on this: it will be his word against her without any proof, the proof won’t be proof when they’re just in the same house at the same time. What’s also weird if he would have entered the house and caught them having sex he wouldn’t have invaded her privacy. If I were him i’d be upset I had to pay money but relieved to be receiving some and if i were her i’d be upset I had to pay money but relieved it could’ve been worse.
Please explain how you’d feel after the partner you are married to cheats on you, then sends you to jail for several months.
Christ, Lemmy really is going downhill. Someone is making an argument of fact, and you’re making an argument on emotions.
These are clearly not the same thing, yet you’re still here making bad faith arguments.
Don’t worry, I’m making arguments of fact elsewhere in the thread.
Just straight up justification for abuse from this user, my goodness.
That doesn’t allow me to start recording them having sex without consent, same as it doesn’t allow me to hit them just because I’m angry.
that’s not what I asked.

Because I don’t think someone should be given free reign to break laws and abuse his spouse because they were caught cheating?
Is he allowed to tie her up and torture her, too? Post those videos online? Rape her?
I’m imagining them coupling and the robot vacuum just chilling in front of them the whole time and moving with them as they switch rooms.
Taiwan sounds like a weird place, if you are not allowed to record a surveillance video in your own home.
It’s irrelevant that it was done with a camera on a cleaner, it’s no different than if it had been a dedicated surveillance. If the article is accurate it sounds like their “reasonable expectation of privacy” focuses more on the individual than the location of the recording. Or maybe it’s different for “intimate acts”.
Which can be true in other countries too depending on the situation, where ownership of the location doesn’t always allow you to record anybody within without consent.
reasonable expectation of privacy
And how did that term become relevant, when fucking in the bedroom she shared with her husband?
From a surveillance perspective, he is clearly an intruder, and she is his accomplish. This judgement is bullshit, and I wouldn’t be surprised if it is overturned if he appeals it. But he probably won’t for $4,700.
to record a surveillance video in your own home.
It sounds less unreasonable if you say “secretly filming people fuck in private”
We also had a thing around here where some tv host got in trouble for using hidden bedroom cameras to record himself with unknowing people, as evidence in case of allegations.
He absolutely had a good reason for that. It was crucial in the divorce settlement. You can’t claim privacy when fucking around in your husbands bedroom.
You can’t claim privacy when fucking around in your husbands bedroom.
According to the courts in this story, yes, she can.
That’s her bedroom, too, by the way. Not just her husband’s.
True that it is shared, but she helped an intruder into their bedroom, he has a right to film the intruder, and it is absolutely her own fault that she was on the pictures too.
The courts found that the husband was at fault here for recording.
What a weird comment to make??? That’s what my entire comment was about to begin with.
A court in Taiwan, which made me comment that Taiwan is a weird place to make such a court judgement .
Repeating it over an over again is not making a point. It’s not her own fault for being the subject of a recording. It’s the husband’s fault for pressing record.
Thank god you’re not a lawyer or involved in legal situations at all.
“it’s abuse to record” but not physical abuse, so it must be emotional then.
Is cheating not emotional abuse? What a weird take.
I wonder if it would be the same thought process if genders wre reversed.
I wonder if it would be the same thought process if genders wre reversed.
Good point. She was aiding an intruder into his bedroom, perfectly justified to record it, especially since it had an impact on their divorce case.
It is 100% he who was wronged. Him recording it is 100% justified. If he had put it on the Internet, or sent it to her friends, that would be different. She can’t complain that he recorded evidence in his own house.
You keep using the word intruder, but the person was invited by a legal occupant. The law doesn’t work on a tit for tat basis, one person’s bad behavior isn’t a legal excuse for someone else’s bad behavior.
I’m surprised he didn’t have a lawyer go through it and delete parts that would get him in trouble.
I agree with your overall logic, but I think you replied to the wrong person. They never even mentioned the word abuse, nor did they say it wasn’t.
Lol yup sure did, but they found the comment
“it’s abuse to record”
You’re the only one who put this quote in a comment here.
Did you read the article? She got punished for cheating within the marriage.
I did, and while I agree that being ordered to pay money for that is bullshit and they should have just gotten a divorce and be done with it, that’s not the point.
He was punished for recording in his own home.
If your neighbours break into your house to have wild sex, they shouldn’t be surprised if they got recorded - but that doesn’t make it legal to record it.
Just like when the neighbours break into your house you’re not allowed to kill them.
Someone breaking one law does not allow you to break another. That can seem unfair and become conflicting, but is a basic truth across the globe.
Just like when the neighbours break into your house you’re not allowed to kill them.
Depends where you are.
This husband wasn’t allowed to record his wife having sex without her consent.
Where’s the line for y’all here? Is he allowed to rape her? Beat her? Torture her? What other crimes is he allowed to commit against her in your opinion?
Velma. You have firmly established that you know how to use a slippery slope and straw man fallacy. We all see your accomplishment. Well done you. If I give you a medal will you stop?
🥇
He wasn’t allowed, he was punished.
She forgot there was a camera in her house when she invited her affair partner over. He didn’t post it online, he used it in court. And again (since you like repeating) he was punished.
He was punished for recording someone having sex without consent.
Yes, you’re not allowed to abuse your spouse even within your own home.
afaict there were two abuses happening that were appropriately each dealt with separately
+1 Taiwan
My statement doesn’t refute that two abuses happened.
do you think it’s abuse when someone hits someone else in self defence?
Recording her having sex without consent is decidedly not the same as hitting someone in self-defense.
gathering evidence of wrongdoing against you in order to be able to defend yourself in court against someone doing you harm is not the same as recording someone having sex for sexual gratification.
EDIT : If I take a picture of someone robbing my house when they are naked, am I getting “nudes” of them?
I am utterly devoid of any sympathy for a cheater. Sorry but it takes a lot of shameless gall to sue someone or press charges for anything after they catch you cheating.
That doesn’t mean you get to abuse someone who has cheated.
You can term this abuse if you want, but I see this as appropriate consequences for a hurtful act IMO. If you don’t like that don’t cheat.
Revenge porn and recording someone having sex without consent is a crime regardless of what that person has done to you to hurt your feelings.
Revenge porn
explain what revenge porn is, and why you think this is revenge porn.
EDIT for viewers at home :
https://en.wikipedia.org/wiki/Revenge_porn
Revenge porn is the distribution of sexually explicit images or videos of individuals without their consent
it may shock some of you to know that evidence for divorce proceedings is not distrobution.
Revenge porn and recording someone having sex without consent
Explain to me why you’re clipping my comment out of context to try to make a point.
Sure, I guess. I suppose it is also illegal for me to beat the shit out of someone who tried to mug me. It’s against the rules for a kid bullied in school to fight back. Certain actions invite harsh consequences. Doesn’t mean it’s not an entirely appropriate consequence to suffer for having cheated on someone.
People don’t learn their lessons without consequences. And anyone who would violate someone’s trust like that certainly has a lesson that needs learning. I don’t get why you’re defending a cheater here, it is a very immature position to take in this situation and such an obvious and reasonable consequence for this person.
Because people are justifying abuse when it’s very rarely, if ever, justified.
One person’s actions don’t justify your abusive actions regardless of how hurt you are.
Cheaters make terrible decisions that hurt their partners. I’m not defending that. But that’s independent of these revenge fantasies you all are coming up with for her.
She was punished by the courts as was he for their separate actions.
And how did he abuse her?
It was her that abused the agreement they entered when they got married. And it was valid course for him seeking divorce and be compensated.By recording her without consent.
It wasn’t a valid course of action, the courts determined he was in the wrong for this.
the courts determined he was in the wrong for this.
For fucks sake that was the basis for my original comment, why do you think you are making an argument repeating that?
Also if it is illegal, why was it accepted in separation court?
Because they are two separate actions - the cheating and the recording.
Is she still a spouse if she’s cheating with sex? No immediately not in my book.
Yes, one is still married until a divorce happens.
Well, that’s not really a matter of opinion lol. Spouse is a specific legal term. They’re still a spouse until a court dissolves the contract.
He probably thinks it sucks

Good thing I am in a state that allows me to record without getting the other persons consent.
That usually doesn’t apply to recording people having sex.
